Please read the
following information before submitting information to the Bonds Online
Texas site. By submission of your form and/or use of
bondsonlinetexas.com, you agree to all of the terms and conditions
of Bonds Online Texas “Terms of Use Agreement”.
Definitions:
Bonds Online Texas is an online insurance & bond shopping service that is
provided by James Stafford Insurance Agency and Data Management Systems
as administrator. BOT refers to Bonds Online Texas. DMS refers to
Data Management Systems. JSA refers to James Stafford Insurance Agency.
General:
This agreement sets for the terms and conditions that apply to your use
of Bonds Online Texas. By submitting the BOT information forms or by
using the service, you are deemed to have agreed to comply with all of
the terms and conditions of this Agreement.
Please be aware that
by submission of online quote form, the following condition applies. As
a part of the underwriting process for all applicants, to provide you
with an accurate premium amount, we have asked a series of questions,
some of which are confirmed through consumer reports, which my include
credit information. By submitting forms for our inspection and process
you hereby accept these terms and conditions. The right to use Bonds
Online Texas is personal to you or members of your immediate family
residing with you and is not transferable to any other person or entity.
Term(s)
Modification
Bonds Online Texas shall have the right at any time to change or
modify the terms and conditions applicable to your use of the BOT or to
impose new conditions with respect to such use. BOT shall have the right
at any time to change or discontinue any aspect of or feature of the BOT, including by not limited to content,
functionality hours of availability, and equipment needed for access or
use. Such changes, modifications, or additions shall be effective
immediately upon notice thereof, which may be given by means including
but not limited to posting on the BOT site, electronic or conventional
mail, or any means by which you obtain actual knowledge. Any use of the
BOT by you after such notice shall be deemed to constitute acceptance by
you of such changes, modifications, or additions.
Disclaimer
of Warranty: Limitation of Liability
Bonds Online Texas, its affiliates, nor any third-party content
providers or licensers makes any warranty whatsoever, including without
limitation: that the operation of bondsonlinetexas.com will be
uninterrupted of error-free; as to the results that may be obtained from
use of bondsonlinetexas.com; or as to the accuracy, reliability,
availability, suitability, quality, or operation of any information,
software, or service provided on or accessible from Bonds Online Texas.

is provided “as is” without warranties of any kind, express or
implied, including without limitation
warranties of title and noninfringement and the implied
warranties of merchantability or fitness for a particular purpose, your
use of Bonds Online Texas is at your own risk.
In no event shall
Bonds Online Texas be liable for any indirect special, incidental,
or consequential damages arising out of or related to the non
performance of a product, service or insurance provided listed on this
site.
Indemnification:
You agree to defend, indemnify and hold harmless Bonds Online Texas,
its affiliates, and their respective directors, owners, officers,
employees, and agents from and against all claims and expenses including
attorneys’ fees, arising out of the use of Bonds Online Texas by
you or your account.
Termination
of Agreement:
Either party shall have the right to terminate this Agreement at any
time by providing notice of termination to the other. In the event of
termination of this Agreement by either party, you shall have no claims
against Bonds Online Texas or it affiliates. Termination of this
Agreement automatically terminates your license to use Bonds Online
Texas and any content or other material contained therein.

Miscellaneous:
This Agreement and any Bonds Online Texas policies relating to your

between Bonds Online Texas and you with respect to the subject
matter hereof, and supersedes all previous written or oral agreements
between the parties with respect to such subject matter. The Agreement
shall be subject to and construed in accordance with the laws of the
State of Texas, Dallas County, Dallas Texas, without
regard to its conflict of laws rules. No waiver by either party
of any breach or default hereunder shall be deemed to be a waiver of any
preceding or subsequent breach or default. The section headings used
herein are for convenience only and shall not be given any legal import.
The provisions of Sections Disclaimer of Warranty, Limitation of
Liability, Indemnification, Termination of Agreement and Miscellaneous
shall service termination of this agreement.
